These terms and conditions and the contract of which they form part shall be governed by English law. All references to "the customer" or "the advertiser" refer to the user applying to place an advertisement for a vehicle on the Justmuranocars.com website. All references to "the website" refers to the Justmuranocars.com internet site. All references to "us" refers to Justmuranocars.com, a division of Open Design Systems Ltd.
Justmuranocars.com reserves the right, in its sole discretion, to amend these terms and conditions at any time by posting on the website the terms and conditions as amended. You should therefore review the terms and conditions each time you visit the web site. The amended terms and conditions will be effective from and after the date they are posted on the website.
This service offers the facility to compose and place an advertisement for a used vehicle on the Justmuranocars.com website.
Duration of placement:
Advertisers are offered the option of placing an advertisement for an unlimited period ("Hold Until Sold Advertisement") on the website. The advertisement will initially remain on the website for a period of two weeks from the date of first publication on the website. The advertiser must then confirm that the advertisement is to remain on the website for another period of two weeks, every following two week period.
To assist the advertiser in confirming that the advertisement is to remain on the website for another period of two weeks, a reminder email will be sent to the email address supplied by the advertiser two days before the advertiser's current period of two weeks expires.
If the advertiser does not confirm that the advertisement is to remain on the website within the period of two weeks, the advertisement will be removed from the site and will be saved in the advertisers personal profile. Justmuranocars will allow a one week grace period for the advert to be reconfirmed in the advertisers personal profile and published at no additional charge. After that period if the advertiser chooses to re-publish the advertisement the Hold Until Sold Advertisement charge will apply.
Duration of trade advertisement packages:
A trade advertisement package ("Trade Ad Package") will expire at a period of one year from the date of purchase by the trade advertiser. All advertisements that are published on the site during the period of one year will remain on the site provided that they are confirmed every period of two weeks as described in the Terms and Conditions - Duration of placement. If any trade advertisements package credits remain unused, a reminder email will be sent to the email address supplied by the trade advertiser one month before the period of one year expires.
Multiple advertisements for the same vehicle:
Justmuranocars.com is only able to display one advertisement for each vehicle at any one time on the website. If the customer orders a subsequent advertisement for a vehicle, which is already advertised on the website, then the subsequent advertisement will replace the previous advertisement for that vehicle.
The time period for the first advertisement will automatically expire when it is replaced by the subsequent advertisement on the website. Justmuranocars.com will not be liable to reimburse the customer for any period in which the first advertisement has been paid for but has not been displayed
Advertisement processing:
A single vehicle may be featured in each advertisement.
The advertiser must ensure that the advertisement copy supplied to Justmuranocars.com is legal, decent, honest and truthful and must comply with the British code of Advertising.
Justmuranocars.com may amend or delay the publication the advertisement to ensure compliance with these requirements.
Justmuranocars.com is unable to verify the truthfulness of any statements or the authenticity of photographs submitted by a customer in the advertisement copy. Accordingly, the customer shall be responsible for any losses, expenses or other costs incurred by Justmuranocars.com caused by an untrue statement or inaccurate photograph supplied by the customer.
In order to meet the technical and production requirements of the website, Justmuranocars.com reserves the right to edit, amend or alter the copy or photograph supplied by the customer.
In the event that Justmuranocars.com is unable to accept an advertisement for any reason, we will attempt to inform the customer of this if at all possible. In the event that we reject the advertisement, no charge will be incurred by the customer. No contract will be deemed to exist between the customer and Justmuranocars.com until the advertisement has been accepted for publication on the website.
Copyright:
The copyright in all adverts (including text and photographs) shall be owned by us and you hereby assign all such copyright to us.
Payment and security:
Payment for all advertisements must be made through our website in advance of your advertisement appearing on the site.
To process card payments we refer you to a dedicated commerce provider, who will take payment via a secure sever (SSL) connection to ensure the safety of your payment on-line.
Payment can be made using Visa, Mastercard, Solo, Switch, Visa Delta and Visa Electron. No other payment method can be accepted.
While every effort is made to ensure the safety of your credit card transaction, Justmuranocars.com can not accept liability for any loss or damage incurred as a result of using the secure payment mechanism.
Delivery of the advertisement - fulfilment timing:
Advertisements will be published on the website after the Justmuranocars.com servers have completed processing the customer supplied advertisement copy, customer details and customer payment information.
This processing time is typically no longer than a few minutes, but it may be extended for an indefinite period at Justmuranocars.con sole discretion due to computer system maintenance or other factors that that necessitate this change.
Advertisement and Trade Ad Package cancellation:
Once an advertisement has been accepted for publication on the Justmuranocars.com website it will not be eligible for a refund.
Once a Trade Ads Package has been purchased on the Justmuranocars.com website it will not be eligible for a refund.
Order confirmation:
As soon as an advertisement has been accepted for publication on the website, a confirmation email will be sent to the advertiser explaining that the advertisement has gone live on the site.
In the event that an advertisement has been rejected for publication, Justmuranocars.com will send an email to the customer explaining why their advertisement has been rejected.
Amending and deleting your advertisement once published:
Once your advertisement has been accepted onto the website, a confirmation email will be sent to you with details on how to amend (or delete when your vehicle is sold) your advertisement once it's published on the site.
Liability:
Justmuranocars.com will require to carry out routine maintenance and service of it's servers and equipment. While Justmuranocars.com seeks to keep disruption to a minimum, it does not guarantee that the advertisement will be continuously available on-line for the duration of the advert.
Where an advertisement does not appear on the website despite confirmation being sent to the advertiser, the customer will be entitled to an additional free week's publication without confirming the advertisement is to remain on the website or a refund of the advertisement price or of the advertisement credit in the case of a Trade Ad Package unless the omission, cancellation or mismatch was caused by unforeseen circumstances beyond the reasonable control of Justmuranocars.com or breach of contract by the customer. Justmuranocars.com liability for breach of contract or negligence shall not exceed an amount equal to the price of the advertisement or series of advertisements involved.
Justmuranocars.com accepts no liability for the movement, shipping, delivery or export of the advertised vehicle. This is the advertiser's sole responsibility. All export conditions for the shipment of a vehicle must be fulfilled by the advertiser.
